Project Data Handling Rules
1. What counts as project data
Project data means schedules, activities, dependencies, calendars, resource, cost and budget information, imported files, calculation results, comments and any other material you submit through the Service.
2. Your rights and responsibilities
- you retain the rights you hold in your project data;
- you confirm that you have a lawful basis to upload, store and process that data, including any data belonging to your employer or your client;
- you are responsible for the accuracy, completeness and lawfulness of the source data and for keeping your own backups of it;
- you must not upload state secrets, classified information, special categories of personal data, biometric data, or any information for which the Service is not intended.
3. What the Provider may do with it
For the period of your use of the Service you permit the Provider and the infrastructure providers it engages to store, copy, transform, analyse and transmit project data to the extent required to operate the functions of the Service, to keep it secure, to make backups, to provide support and to comply with the law.
This permission does not transfer any intellectual property rights in your project data and does not allow it to be used for any other purpose. In particular, the Provider does not use your project data to train machine-learning models, does not use it to create public benchmarks or marketing materials, and does not disclose it to third parties other than as described in these Rules and in the Privacy Notice. Any use of your data in a case study or demonstration requires your separate written permission.
4. Confidentiality and access
Project data is accessible to the members of your workspace and to authorised persons who need access to operate and support the Service. You control who is invited to your workspace and with what role. Support access to the content of a workspace is used only where necessary to investigate a fault or a security issue, and administrative actions are recorded in an audit log kept for the period stated in the Privacy Notice.
5. Personal data inside project files
Schedules and resource records may contain personal data of your employees, contractors or other individuals. Where they do, you determine the purposes of that processing and are responsible for having a lawful basis for it and for informing those individuals; the Provider processes that data on your behalf and only as described in clause 3. If your organisation requires a separate data processing agreement, contact support@balancier.pro before uploading such data.
6. Storage, export and deletion
Project data is stored for the period of your use of the Service and may persist in backups for a technically necessary period. You may export your data using the export features of the Service at any time while your account is active. Following an account deletion request, project data is deleted within 30 days, after which residual copies are removed from backups in the ordinary backup rotation.
During the pilot phase the Service is provided free of charge and without a guaranteed data retention commitment. Keep your own copies of source files and of any results you rely on.
7. Verifying imports and results
Import, transformation and calculation depend on the structure and quality of the source files. You must check the completeness of each import and the results of processing before using them. Further limits are set out in the Disclaimer and Limitation of Liability.
